On November 2, 2010 the City of Sanford will hold a Regular Election in which the voters will elect
a Mayor and a City Commissioner in District 1.

There are two qualified Mayor candidates:

Hank Dieckhaus
Mark McCarty

Qualifications:
All candidates and elected members of the City Commission must be a resident of and a qualified elector, not a convicted felon whose civil rights have not been restored, in the City of Sanford. In addition, candidates for Commissioner and elected Commissioners must also be a resident in the district in which the candidate runs for Commission office.

To qualify:
To qualify to run for Mayor or for City Commissioner, complete and file the following forms with the City Clerk and pay the fees.
  • Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates [Form DS-DE 9], then open Campaign Account. The candidate may designate himself as his Campaign Treasurer or Deputy Treasurer.
  • Affidavit of Residency. Documentation of residency is also required.
  • Loyalty Oath and Oath of Candidate. [Form DS-DE 25]

  • Statement of Financial Interests [CE FORM 1].

  • Pay qualifying fee by check drawn on Campaign Account:
         Mayor: $540 (City $450 and State Election Assessment $90)
         Commissioner: $450 (City $375 and State Election Assessment $75)
         (Candidates qualifying by Petition submit Certification of having obtained a sufficient number of qualified signatures and pay State Election Assessment)
         (Write-in Candidates pay no fees)
It is the candidate’s responsibility to ensure that all necessary forms, fees and documents are complete and filed during the qualifying period. No forms, fees or documents required for qualifying, or additions, revisions, substitutions, etc. will be accepted after the close of qualifying.

NOTE: Before a person may accept campaign contributions, they must first file an Appointment of Campaign Treasurer and Designation of Campaign Depository form with the City Clerk, and then open a Campaign Account. They may do this at any time. They are then subject to the laws governing candidates, as described in Chapter 106, Florida Statutes, and in the Candidate and Campaign Treasurer Handbook. Applicable forms can be downloaded from the Elections page of the City of Sanford website www.sanfordfl.gov and are also available online from the Florida Division of Elections at: http://election.dos.state.fl.us.

Qualifying by Petition:
A person seeking to qualify for Mayor or Commissioner may be eligible to qualify to have his or her name placed on the ballot by means of the petition process. A person who obtains the required number of signatures is not required to pay the City 5% qualifying fee.
  • Candidates are required to use the City of Sanford Candidate Petition form to obtain signatures of registered voters. Contact the City Clerk to obtain the City of Sanford Candidate Petition form.
  • All petitions for placing candidate’s name on the ballot must be received by the City Clerk’s office in time to allow for processing by the City Clerk’s Office and Supervisor of Election’s Office prior to Noon on August 6, 2010.
  • Candidates for Mayor must obtain 500 signatures of eligible voters residing within the City.
  • Candidates for Commissioner must obtain 250 signatures of eligible voters residing within the Commission district seat the candidate seeks.
There is a $.10 per signature fee for verification of voter signatures. A check in the appropriate amount and payable to the Seminole County Supervisor of Elections must be submitted to the City Clerk with each petition. A candidate unable to pay the fee may submit an Affidavit of Undue Burden.

Qualifying as a Write-in Candidate:
A write-in candidate is not entitled to have his or her name printed on the regular election ballot; however, a space for the write-in candidate's name to be written in shall be provided on the regular election ballot. A write-in candidate is not required to pay a qualifying fee or election assessment.

Resign to Run (Section 99.012, F.S.):
No officer may qualify as a candidate for another state, district, county, or municipal public office if the terms or any part thereof run concurrently with each other without resigning from the office he or she presently holds. The resignation is irrevocable.

The written resignation must be submitted at least 10 days prior to the first day of qualifying for the office he or she intends to seek (for this election the deadline is July 23, 2010). The resignation must be effective no later than the earlier of the following dates: (1) the date the officer would take office, if elected; or, (2) the date the officer's successor is required to take office.

Campaign Treasurer’s Reports. (Section 106, F.S.)
Campaign Treasurer's Reports are filed electronically on the Seminole County Supervisor of Elections website, then printed, signed, and the signed original filed with the City Clerk not later than the date due.

Penalty for Late Filing.
There is a penalty for failing to file the Treasurer's Report on the due date. See Section 106.07(2) and (8), F.S., and the Candidate and Campaign Treasurer Handbook.
